General conditions and conditions of ordering the goods.

The scope and operation of the conditions
1.1. The terms and conditions apply to all legal relationships that arise between the persons and the owner of the trading environment www.mixpack.ee (hereinafter referred to as “the online store www.mixpack.ee”) when purchasing goods through the online store www.mixpack.ee.

1.2. In addition to the current conditions, the legal relations arising from the purchase of goods through the online store www.mixpack.ee are governed by the laws of the Republic of Estonia.

1.3. Based on the interests of the best and safer development of the online store www.mixpack.ee, the Mixpack OÜ has the right to modify and supplement these terms and the price list. To amend or supplement the terms and price list, customers are notified via the website www.mixpack.ee. Amendments and supplements to the terms and price list come into force from the moment of publication of the relevant amendment or supplement on the website www.mixpack.ee. If you have made an order before the entry into force of the amended conditions, applicable to the legal relationship between you and the Mixpack OÜ, the conditions in effect at the time of your ordering shall apply, unless otherwise provided for in the law or in the present conditions.

Prices

2.1. The prices in www.mixpack.ee are valid with the timely payment of the invoice in accordance with clause 4.

2.2. All prices in the online store are in euros (EUR) and include the value-added tax of 20%.

 

Goods

3.1. The goods presented in the E-Store are usually available in the warehouse or in the seller’s shops. The availability of such products is not guaranteed because errors may occur due to possible technical failures in the E-Store programs.

3.2. If the Customer places an order, but it turns out that the necessary Goods are not in stock, the Electronic Store cannot fulfill such order. In this case, when the lack of goods is revealed, the customer is returned the amount paid by him.

3.3. The photos in the E-Store are illustrative, and the products depicted on them may unintentionally differ insignificantly from real Goods.

 

Making a purchase

4.1. After selecting a product in the online store, the Customer adds the product to the shopping cart by clicking on the “Add to Cart” button.

4.2. To place an order, the Customer must go to the shopping cart page: in the menu in the shopping cart selection, click on the “Go to payment” button, then the Customer will be redirected to the order registration site.

4.3. After entering and verifying the correctness of the required data, the Customer confirms the order by clicking the “I confirm and pay” button. After this action, the order is confirmed and sent to the seller.

4.4. The Customer pays for the Goods by means of a bank link of the Internet bank, and also confirms payment to the Seller by clicking on the “Return to the Seller” button.

4.5. When placing an order, the Customer undertakes to provide the correct data to fulfill the order.

4.6. A registered customer who logged into his account and stored the required data in the account can use the quick payment function.

4.7. After payment for the Goods, the E-Store sends the Customer an order confirmation via e-mail.

4.8. When placing an order, the Customer undertakes to provide reliable information necessary for the fulfillment of the order.

4.9. When executing the order, the Seller is not responsible for the impossibility of fulfilling the order, due to incorrect data provided by the Buyer or any consequences of such submission.

4.10. The Seller has the right to refuse to execute the order if there is a suspicion of the reliability of the data provided to the Seller or in behavior that does not correspond to good traditions.

 

Payment Methods
5.1. The order can be safely paid using the Estonian bank links (Swedbank, SEB, Nordea, Danske, LHV, Krediidipank, Coop and others) as well as by credit card (Visa, MasterCard, Maestro).

5.2. The payment is made outside the online store in the secure payment environment of Maksekeskus AS.

5.3. The Seller does not have access to the Customer’s banking data.

 

Delivery and transfer of the order

6.1 Our delivery services cover the entire territory of Estonia. If you want us to deliver an order outside the above-mentioned region, it occurs on special agreement, for the conclusion of which please contact us at [email protected] and by phone +372 560 57537.

6.2. Orders are delivered by a courier of the DPD logistics company within the term and time indicated on the product card and the order confirmation. More detailed information:

6.2.1 The goods are delivered according to the delivery price list.

– The courier will deliver the goods at the address specified by you when placing the order. A later change of destination is only possible by agreement.

6.3. When placing an order, make sure that the contact information provided is correct to avoid delays and misunderstandings when delivering an order. www.mixpack.ee (the Mixpack OÜ) and the courier are not liable for delays and misunderstandings in the delivery of goods in case the delay or misunderstanding is due to inaccuracy or incorrectness of the data specified by you when you make the order.

6.4. The goods will arrive at your chosen address within 5 working days from the date of sending the order confirmation to the Customer’s e-mail address. The courier will contact the Customer by phone and agree on the appropriate delivery time. In a case of an unsuccessful attempt to issue the Goods, the parcel will be returned back to the warehouse of the sender.

6.5. If the Customer has issued an order at the weekend (from 13:00 on Friday to 09:00 on Monday) or on a national holiday, the period of 5 working days starts from 09:00 on the first working day after the weekend or public holiday.

6.6. Before placing an order, the Customer is obliged to verify the accuracy of the provided contact information in order to avoid delays and misunderstandings when delivering the Goods. The Seller shall not be liable for the delay and misunderstanding caused by the delivery of the Goods in the event that the delay or misunderstanding is caused by inaccuracy or incorrectness of the data provided by the Customer when placing the order.

6.7. The courier delivers you the order with an intermediate account. If you have any problems, please immediately inform us by phone +372 560 57537. The right to claim does not cover the damage that arose after the goods were transferred to the buyer.

6.8. In the event that the Order has not arrived to the Customer in a good condition and in a sealed package, the Customer must notify thereof by sending a message of the relevant content together with the photo to the address: [email protected] or by calling +372 560 57537.

Cancellation and Returns
7.1. The client has the right to withdraw from the transaction within 14 days and exchange or return the ordered Goods. The calculation of the specified 14-day period begins from the date of receipt of the Goods by the client.

7.2. For the return / exchange of the product, the customer must submit the seller an application for return within 14 days from the receipt of the product by the customer. The return can be submitted as follows:
• Send a completed return form together with the goods to the Seller
• Send a simple e-mail to [email protected]

Exchange or return is only accepted together with a completed return form.

7.3 The customer must return the goods within 14 days following the submission of the application or provide evidence that during the above period he transferred the goods to the logistics company. The seller has the right not to refund the money until the consumer returns the item or presents evidence that he has sent the goods.

7.4. The exchanged or returned Goods must not be damaged, must be in the original packaging, containing all original labels thereon.

7.5. The order purchased is not refundable if the ordered goods are manufactured according to the personal needs of the customer, or according to the conditions provided by the customer.

7.6. If the condition of the returned order (and order packages) has deteriorated and the reason for the deterioration are (i) circumstances that are not due to the activities of the Mixpack OÜ; and (ii) as a result of misuse of the goods, the Mixpack OÜ has the right to recalculate the reduction in the value of the goods at the expense of the amount paid for you for the goods and the amount refunded to you. To process the recalculation, the Mixpack OÜ will send you an application for recalculation to the e-mail address you specified when placing your order.

7.7. In the event of an exchange, the E-Store will send the new Item to the Customer immediately upon receipt of the Goods to be exchanged. Expenses related to the exchange shall be paid by the Seller.

7.8. The Seller will return the money to the Customer within 14 days after receiving the return form by the E-store. The return shall be made to the same account from which the payment was made by the Client.

7.9. In a case of return of the order, the seller returns to the customer the entire amount received on the basis of the contract, including the shipping costs. If the order is returned in part and the payment for the delivery is added to the order, the Seller can reimburse the delivery costs in proportion to the quantity of the returned goods.

7.10. Refund of money to the Customer’s bank account shall be made no later than on the next business day. When paying by credit card – in accordance with the terms of the Customer’s bank.

 

Liability and force majeure

8.1. Www.mixpack.ee (the Mixpack OÜ) is liable to you, and you are liable to www.mixpack.ee (the Mixpack OÜ) for damages caused to the other party by a violation of these terms and conditions, in the cases and in the amount specified in applicable legal acts of the Republic of Estonia.

8.2.  Www.mixpack.ee (the Mixpack OÜ) is not liable for any damage or delay in the delivery of the order in the event that the damage or delay in the delivery of the order is due to the circumstance that www.mixpack.ee (the Mixpack OÜ) could not have impacted or the onset of which www.mixpack.ee (the Mixpack OÜ) did not foresee or could not foresee (force majeure circumstances).

8.3. The Customer undertakes to use the services of the Electronic Store only for purposes not inconsistent with the law or generally accepted norms.

 

Data protection and processing principles

9.1. By registering in the E-Store or making a purchase, the Customer agrees with the terms of use of the Electronic Store and agrees to comply with them.

9.2. The contract of sale between the Seller and the Customer comes into force from the moment of receipt of the amount of the purchase to be paid on the Seller’s settlement account.

9.3. The Customer gives the Seller an unambiguous and informed consent to the processing of their personal data.

9.4. The personal data reported to the Seller is entered in the customer register and used to provide services for the sale and offer of goods to the Buyer.

9.5. The seller keeps the contact information of the customer as well as information about the purchases made. This information is confidential and processed in accordance with the law on the protection of personal data. Personal data required to send the Goods to the Customer is provided to the courier.

9.6. The Seller can use the Customer’s personal data to send information about special offers and campaigns to the Customer by e-mail only if the Customer has given his consent thereof.

9.7. All personal data of the client, which became known during the visit to the online store www.mixpack.ee and the purchase in it, are treated as confidential information. The encrypted data channel with banks ensures the security of personal data and bank details of the buyer. Www.mixpack.ee (the Mixpack OÜ) does not have access to them.

9.7.1 The online store uses personal data entered by the buyer (including name, phone number, address, e-mail address, bank details) only for processing the order and sending the goods to the buyer.

9.8. The seller provides protection and use of the data of the Buyer, incl. personal data, in accordance with the terms of the privacy policy. The buyer confirms that he has read and accepts the terms of the privacy policy. Based on current legal acts and the content of the terms of the privacy policy, the Seller, without the consent of the Buyer, has the right to process the data (including personal data) in the amount necessary to use the online store. Among other things, based on the foregoing, the Seller without the express consent has the right: to send to the Buyer notices related to the use of the online store services, incl. notices that are sent to the user of the Internet store for security reasons; for the best customer service and confirmation of transactions save data of orders entered into the system of the Buyer, incl. in reasonable time about those orders, the completion of which the Buyer did not complete during the session.

9.7. If the Buyer, at the conclusion of the Customer Agreement or otherwise, by the action confirming the will of the Buyer (for example, in self-service), consents to the marketing use of the data, the Seller shall use such data on terms and for the purposes stated in the privacy policy, including for sending personal direct marketing offers about goods and services to the Buyer, offers within the campaign and preferential offers by electronic means of communication (for example, by e-mail or SMS).

9.8. At any time, the Buyer has the right to withdraw his consent to the marketing use of the data by sending the seller an electronic letter of the relevant content or refusing to receive further offers of direct mail by following the directions contained in the direct mailing offer sent to his e-mail.

9.9. In matters not covered separately under these conditions, the parties are guided by the legal acts in force in the Republic of Estonia.

9.10. Disputes arising between you and www.mixpack.ee (the Mixpack OÜ) in connection with the purchase of goods through the online store www.mixpack.ee, are resolved through negotiations. If it is not possible to reach an agreement, you have the right to apply for protection of your rights to the Consumer Protection Board or to the City Court of Tallinn. Dispute resolving is guided by legal acts in force in the Republic of Estonia.

10.2. The Mixpack OÜ reserves the right to make changes in the prices of the goods and in its presence as well as in exceptional cases to refuse to sell the goods.
